You agree that your use of the CoWorking Office and the CoWorking Office Website is at all times subject to the following terms and conditions, referred to as the Terms of Use. By signifying acceptance of the Terms of Use on the CoWorking Office Website, you agree to be bound by the Terms of Use and the CoWorking Office Privacy Policy.
Please Note: We reserve the right not to accept walk-ins and bookings on the day of your requested booking date, so to secure your spot please book at least before 5 pm the day before the date you want to come into the CoWorking Office. If you have a question before booking, please call 07 5592 2685.
If you do accidentally make a booking on the day of the requested date that you want to use the facilities and we cannot accept your request we will refund you your booking cost.
Payment must be received before your requested booking date, either online via our booking form or via requested invoice by you to us. If you do not show up on the day you have booked or cancel on the day you are expected in the CoWorking Office Space, there will be no refunds.
Your paid booking entitles you access to the CoWorking Office facilities (for the requested time period in your booking), including the desk space, kitchen and use of the phones for national calls only, some printing and coffee, tea and snacks. Your paid booking does not include the use of the meeting room unless specifically paid for within your paid booking.
The space is a shared office and asks that you consider other people using the space also in a respectful way. Offensive language, threatening behaviour, abuse of our staff and other office users, and damage to our property will not be tolerated. We reserve the right to remove offenders from the CoWorking Office Space in any such occurrence.
The CoWorking Office Space is a collaborative workspace, and you may find that you are working in close proximity to individuals or companies that are in competition with your business. It is your responsibility to ensure that any obligations you may have regarding proximity and/or confidentiality with respect to such competing companies and other users of the office space are generally adhered to.
You acknowledge that due to the shared nature of the CoWorking Office Space, sensitive information may sometimes be overheard, and you agree to respect the right to privacy and confidentiality of other users of the office space in such circumstances.
We ensure that Our Property is maintained in a good condition and complies with any applicable legal or other regulatory requirements. It is your responsibility to ensure that Your Property is fit for purpose and is used in a safe manner. Your Property is your responsibility and CoWorking Office is not liable should anything happen to Your Property while on the premises.
Users must only use the space for office purposes.
Smoking is prohibited on the premises.
Users must not conduct an auction or sale on the premises or use the premises for any medical or retail activities.
You are responsible for making good or indemnifying us (and do hereby authorise us to charge you) for any damage caused to the CoWorking Office Space or Our Property by you, your employees or your team members (excluding fair wear and tear).
Confidential Information includes information relating to either party’s business, employees, clients, products and business processes. Any Confidential Information you give us, or we give you, remains confidential. We have adequate policies and procedures in place to protect the Confidential Information you disclose to us and you agree to take reasonable care to protect any Confidential Information we may disclose to you and not disclose it to any third party.
You are responsible for ensuring that your Confidential Information, and that of any of your team members, remains secure within the CoWorking Office Space and through your use of the facilities. We will not be liable for any unauthorised disclosure of your Confidential Information unless such disclosure occurs as a result of a breach of our confidentiality obligations to you.
For security purposes, there are security cameras around the premises, so you may regularly be recorded via video in certain areas of our premises. If we deem it reasonably necessary, we may disclose information about you to satisfy applicable law, rule, regulation, legal process or governmental request, or to protect us, other users, other individuals, or any of our or their property. It is your obligation to notify any of your team members or agents about this policy.
The CoWorking Office Website may contain links or other references to Third Party Websites. If it does, you agree that we have no liability or responsibility for the condition, safety or content of those websites, and you acknowledge that a link or a reference to a Third Party Website does not imply any endorsement, approval or sponsorship of the website or of any product or service available through it. We make no representations or warranties whatsoever, either express or implied, regarding any Third Party Website, including as may be said to arise from the existence of a link or reference on the CoWorking Office Website.
Copyright in the CoWorking Office Website, including all text, graphics, logos, icons, sound and video recordings, and software is owned or licensed by us.
You agree that you will not in any form or by any means:
We maintain a public liability insurance policy that covers the CoWorking Office Space and we carry our own contents insurance. Our contents insurance does not extend to Your Property or the property of your team members. You should make your own insurance arrangements to ensure that Your Property and any other liabilities are covered, including public liability and meeting any State or Territory worker's compensation insurance requirements.
Our staff oversee the CoWorking Office Space during business hours (9.00 am to 5.00 pm, Monday to Friday, excluding public holidays), however, we do not accept responsibility for loss or damage to any of Your Property left unattended or unsecured in the CoWorking Office Space.
Our liability to you for breach of these Terms will be capped at an amount equal to the Fees that you have paid in the 1 month prior to the claim arising. We will not be liable for any indirect or consequential loss, including any loss of actual or anticipated business, income or loss of opportunity.
You will indemnify us for any loss incurred by us or any claim against us resulting from a breach of you by these Terms or any action of your team members and or employees or guests you bring into the CoWorking Office Space.
Nothing in these Terms shall exclude or limit any rights or remedies you may have under the Australian Consumer Law (ACL), set out in schedule 2 of the Competition and Consumer Act 2010.
We are not liable for the actions of other individuals. We do not control and are not responsible for the actions of other individuals using the CoWorking Office Services at our Premises. You should be aware that other users may not be who they claim to be. We do not perform background checks on our users nor do we guarantee that our users or profiles are accurate. We do not endorse, support or verify the facts, opinions or recommendations of our users.
From time to time, we may investigate any actual, alleged or potential violations of these Terms. You agree to cooperate fully in any of these inquiries. You waive any and all rights against CoWorking Office and our partners and agree to hold them harmless in connection with any claims relating to any action taken by us as part of our investigation.
To the extent permitted by law, the aggregate monetary liability of any of the CoWorking Office and our partners to you or your team members, employees, agents, guests or invitees for any reason and for all causes of action, whether in contract, tort, breach of statutory duty, or other legal or equitable theory will not exceed the total amounts paid by you to us under these Terms for the product or service from which the claim arose.
We are committed to maintaining the confidentiality and security of your personal information and managing it in an open and transparent way. We take our obligations under the Privacy Act 1988 and the Australian Privacy Principles very seriously and have implemented practices, procedures and systems to ensure we comply with those laws.
CoWorking Office and our partners are committed to ensuring the health and safety of its users within the premises.
To this end, this policy sets out the minimum steps that the Organisation is taking in order to manage the coronavirus situation, alongside expectations that are placed upon you to help us make the space as safe as possible.
1. CoWorking desk space allows for safe distancing from you and your team members from other users on the premises.
2. Soap is provided to enable you to wash your hands.
3. Clinical grade hand sanitiser is placed at the entrance of the office to enable you to sanitise your hands.
4. Cleaning and disinfecting in accordance with guidance from Safe Work Australia and public health authority is conducted regularly at the premises.
5. Frequently touched surfaces belonging to the Organisation (including counters, handrails, doors, phones, and EFTPOS facilities) are regularly cleaned.
If you begin to display symptoms of the virus, you must follow Government guidance to find out what to do next. You must seek medical attention (be tested) and notify management at the earliest opportunity.
You must not attend the space during any self-isolation period that the Government requires you to undertake.
